Duration: Full Day – 8:30am to 5:00pm

Number of Delegates: 6-15

Course Overview

The course is divided into ten sessions, each concentrating on the NEC4 Engineering and Construction Contract (ECC) provisions. The course is highly interactive with opportunities to discuss any aspect of the NEC4 ECC. See below for a closer look into each session:

In the first session, you are introduced to NEC contracts, their significant impact on contractual behaviours, and how NEC4 has specifically transformed the industry. We will concentrate on management procedures contained within the contract.

You will also explore the close connection between the NEC4 Engineering and Construction Contract and other relevant contracts within the NEC family.

We will delve into the primary methods for effectively procuring projects using the NEC4 ECC. Exploring Main Options, Secondary Options and Z clauses, you will be given an in-depth breakdown of each with supporting contract documentation.

This session comprises a deep dive into certain key definitions and concepts such as Accepted Programme, Completion and Defect.  It also explains the process for dealing with ambiguities and inconsistencies.

Early Warnings are a key element of the NEC4 ECC and continue to be misapplied within the construction industry.  We will run through the correct use of Early Warnings and how they differ in nature from compensation events.

Identified terms are contained in the Contract Data and throughout the day we will refer to the document to explain how to complete this correctly.

Timelines are imperative in construction projects, and this course segment offers clarity on just how important.  We cover elements of this throughout the day and in this session, we concentrate on setting up the programme and assessing delay.  We will also cover the intricacies of planning and the role of the Accepted Programme in managing delivery.

In this session we explain what Defects are under the NEC4 ECC and how they are identified and managed during delivery and after project completion.

Here we look at how the total contract price is derived for each Main Option as well as how payments are made. Disallowed Costs and Defined Cost through the Schedule of Cost Components schedules will also be touched upon.

An important area of NEC4 ECC is the management of change control through compensation

events. We discuss these throughout the day and take a deep dive into this element during this session, looking into how to identify, formally notify, assess and implement compensation events under the various scenarios described in the contract.

Questions are invited and dealt with all through the day. However, to finish this introductory NEC4 ECC course, you will collaborate with those around you as you recap the key points learnt in all sessions and ask any final questions or queries you may have regarding anything discussed throughout the day. Expect an open forum, clarifications and additional insights.
